NOTICE IS HEREBY GIVEN that Jefferson County received an application for a preliminary plat for the project described below. On April 16, 2024, Jefferson County determined the application is complete. Project Name & File No.: Pleasant Harbor Master Planned Resort, File No. SUB2023-00025 Project Description: Preliminary plat application to develop the Pleasant Harbor Master Planned Resort (PHMPR). PHMPR was approved by Ordinance No. 01-0128-08 on January 28, 2008, and is regulated under a Development Agreement (executed on June 6, 2018) with amendments (dated June 4, 2018 and July 22, 2019). The project includes the construction of up to 890 residential units; up to 56,608 square feet of commercial space; a recreation/community center with indoor swimming pools, hockey rink, soccer field, go-cart track, racket sports, health spa, restaurants, and pub; a farmer’s market; a conference center; a nine-hole golf course; and other site amenities. Facilities to serve the development will be provided, including an on-site wastewater treatment system, a community water system, stormwater management, and internal roads and pedestrian pathways. The preliminary plat will create 216 residential lots for various detached and attached dwelling units for both temporary and permanent occupancy and 37 tracts for residential and commercial buildings, golf course fairways, private roads and utilities, open space, storm drainage, and park-and-ride. The preliminary plat has been modified from its initial submission to be consistent with the Phasing Plan in Section 10 of the development agreement, as amended. No construction is authorized as part of the preliminary plat application. Studies: stormwater drainage report SEPA Environmental Review: A Final Environmental Impact Statement (FEIS) was completed on November 27, 2007, and a Final Supplemental Environmental Impact Statement (SFEIS) was completed on December 9, 2015. The project as proposed is consistent with the analyses performed in these EISs. These documents are final and no further environmental review is currently required. Changes to the project or potential environmental impacts beyond the scope of the EISs may be subject to additional SEPA review. Comment Period: A 20-day comment period is being used pursuant to Sec. 8.5 of the Development Agreement, JCC 18.40.220, and RCW 58.17.095 to receive written comments on the preliminary plat application. Agencies, Tribes, and the public are invited to submit written comments to the Agency Contact listed below. Comments must be submitted by 4:30 PM on May 21, 2024. The applicant shall be provided all comments and has seven days from receipt of the comments to respond to them. Any person can make a comment, view the application materials, receive notice of and participate in public hearings, and request a copy of the decision once made. Date of Application: November 20, 2023 Date of Complete Application: April 16, 2024 Date of Notice of Application: May 1, 2024 Consistency Review: The project is regulated by a Development Agreement, two Amendments to the Development Agreement, and other governing documents that set forth applicable development standards, conditions, allowable uses, and mitigation requirements for the project. Public Hearing and Appeal Rights: This is a Type III permit and pursuant to JCC 18.40.040, Table 8-2, the final decision is made by the Jefferson County Hearing Examiner, after a hearing held on the proposed plat pursuant to RCW 58.17.095, Chapter 2.30 JCC, and the Hearing Examiner Rules of Procedure. Notice requirements for the hearing before the Hearing Examiner shall be in conformance with RCW 58.17.090, Chapter 2.30 JCC, and the Hearing Examiner Rules of Procedure. The ninety-day period for approval or disapproval of the proposed plat provided for in RCW 58.17.140 shall commence with the date of the notice setting the hearing before the Hearing Examiner. Per JCC 18.40.340 and JCC 2.30.130, a party of record with standing may appeal the Hearing Examiner’s decision on a preliminary plat to a court of competent jurisdiction consistent with applicable state law.
